Jim has been a partner in the firm since 1990. He is the author of Basic Practice: FERC, a book describing FERC's regulation of the electric, natural gas, oil pipeline and hydroelectric industries first published in 2003 by the American Bar Association. He authored a second edition of Basic Practice: FERC, published in September 2009. He has broad experience representing electric utilities, natural gas pipelines and customers of natural gas pipelines before FERC. He has represented clients in matters which include restructuring issues in the electric and natural gas industries, rate cases, tariff amendments, certificate applications, contracts and accounting issues. He has participated in litigation involving the prudence of nuclear plant operations, the sale-leaseback of a fossil plant, qualifying facilities, decommissioning costs and stranded costs. He has prepared applications for the acquisition and disposition of facilities under the Federal Power Act and has represented clients in cases involving certificate and abandonment applications under the Natural Gas Act. He has extensive experience in litigation arising from the restructuring of the California electric industry.
Jim served as a trial attorney and as a supervisory trial attorney at FERC both in the Enforcement Division and the Gas & Oil Litigation Division from 1980 through 1986. In the course of his work at FERC, Jim made several presentations to the Commission and actively litigated several cases before administrative law judges. He also worked on hydroelectric, public utility and natural gas matters during his tenure at FERC.
Prior to moving to Washington, Jim worked for law firms in California, concentrating particularly on business litigation from 1974 through 1980. His representation of businesses and individuals included contract disputes, commercial torts, estate planning, tax issues, land sales, antitrust litigation, securities, liens and labor law.
Jim graduated with a B.A. from Harvard College, cum laude, and from Harvard Law School, cum laude. He is a member of the Energy Bar Association, where he has served on several committees. He is also a member of the American Bar Association and its Natural Resources, Energy and Environmental Law section. He is admitted to practice in the District of Columbia and Maryland and has been admitted to various U.S. District Courts, U.S. Courts of Appeals, and the U.S. Supreme Court.
