| FERC Puts EQR Plans on Hold |

We reported in July that FERC was gearing up to completely renovate its EQR filing system. FERC has now decided to put those plans on hold while it explores various options with respect to new EQR software. There was a great deal of unhappiness expressed at the July EQR technical conference and during the months that followed concerning the potential costs of implementing new EQR software. Some parties also made informal requests for FERC to issue a NOPR to elicit comments on how new EQR software would function and any new filing requirements associated with such software.
For the time being, EQR filers will continue to use the existing FoxPro software to submit EQR reports. We will continue to monitor FERC's progress with respect to any new software. FERC will most likely issue a NOPR on this subject, although currently there is no indication of when that will happen.
