Non-Jurisdictional Entities
As the scope of FERC’s jurisdiction has broadened, BGM has expanded the scope of its representation to include electric cooperatives, municipal utilities and public power agencies. Our long history representing public utilities before FERC enables us to assist utilities t hat historically have not been subject to FERC regulation. We provide advice to electric cooperatives, government-owned utilities and other public power agencies on open access “reciprocity” tariffs, the requirements of Section 211A of the Federal Power Act that apply to transmitting utilities, and compliance with the FERC Standards of Conduct, market manipulation rules and market behavior rules as well as NERC’s Reliability Standards and FERC rulemaking proceedings that affect them. We also provide those utilities the same assistance that we provide to public utilities with respect to all aspects of utility operations, including interactions with Regional Transmission Organizations and Independent System Operators, regional transmission planning, generator interconnections and the drafting and negotiation of contracts.
