Oil Pipeline Regulation

FERC regulates oil pipelines under the Interstate Commerce Act (ICA). BGM has represented an oil pipeline in connection with its cost-of-service-based rate changes and FERC’s related ICA indexing rate methodologies and procedures. We also have represented an oil pipeline in connection with ICA tariff modifications reflecting operational changes.

Our attorneys represented the Regulatory Commission of Alaska in complex litigation involving the Trans Alaska Pipeline System (TAPS) and FERC’s regulations implementing the ICA. We are familiar with the federal TAPS litigation, the TAPS Settlement Agreement, the TAPS Settlement Methodology, and state issues affected by TAPS including state-determined rates, undue discrimination and cost allocation among the TAPS carriers.
